This letter transmits to the Ohio Administrative Code (OAC) rules
which address the PCSA requirements for complaint review and report disposition
appeal policy, case record, and county memorandum of understanding. These rules
have been reviewed under five-year review requirements, with no resulting changes
to 5101:2-33-23, and 5101:2-33-26. Only one minor revision was made to 5101:2-33-20.
Rule 5101:2-33-20 will become effective August 15, 2020. No-change rules 5101:2-33-23
and 5101:2-33-26 retain their prior effective dates.
OAC 5101:2-33-20 entitled PCSA Complaint
Review and Report Disposition Appeal Policy sets forth the PCSA requirements
for developing a written policy to receive, review, and resolve complaints and report
dispositions. A minor revision was made to remove a reference to a rescinded rule.
There are no recommended changes to the following rules.
OAC 5101:2-33-23 entitled Case Records
for Children Services sets forth the PCSA requirements for maintaining
case records. This rule outlines the type of record to be kept, the duration of
time, and the method in which it is to be maintained.
OAC 5101:2-33-26 entitled The County
Child Abuse and Neglect Memorandum of Understanding sets forth the
PCSA expectation to create a document outlining the normal operating procedures
by all concerned officials in the execution of their respective responsibilities
pursuant to division (J)(2) of section 2151.421 of the Ohio Revised Code when conducting
child abuse or neglect assessment/investigations. The purpose of the memorandum
is to delineate the roles and responsibilities of each official or agency in assessing/investigating
child abuse or neglect in the county.
INSTRUCTIONS:
The following chart indicates the materials that should be removed
from the Family, Children and Adult Services Manual (FCASM) and the materials that
should be added.
