SUBJECT: Food assistance: sponsored aliens.

In accordance with section 106.03 of the Ohio Revised Code (ORC), each state agency is required to review each of its rules in the Ohio Administrative Code a minimum of once every five years. The intent of the review is to ensure that Administrative Code rules are clearly written and that program requirements are accurate, up-to-date based on regulations from the United States Department of Agriculture (USDA) Federal and Nutrition Services (FNS) and clearly expressed. To the extent possible, unnecessary paperwork will be eliminated, local agencies will be given increased flexibility, and any adverse impact on businesses will be eliminated or reduced. As a result of the review, the agency may amend the rule; rescind the rule; or continue the rule without amendment.

These rules have been subject to a review by the Joint Committee on Agency Rule Review (JCARR). The changes will become effective on 06/01/2021.

Chapter 6000

5101:4-6-31 "Food assistance: sponsored aliens.”

This rule describes the eligibility of sponsored aliens, when to count a sponsor and sponsor’s spouse’s income and resources to determine eligibility, and the county agency’s responsibilities. Proposed changes to the rule include:  

  • Language was added to paragraphs (B), (C), (D), (E), (F) and (G) for clarity.

Chapter 7000

5101:4-7-14 "Food assistance: systematic alien verification for entitlements program."

This rule describes the process of accessing and using the systematic alien verification for entitlements (SAVE) program to verify the validity of documents provided by aliens applying for Supplemental Nutrition Assistance Program (SNAP). Proposed changes to the rule include:  

  • Paragraph (B)(1) was moved to Paragraph (A);
  • Paragraph (B) was amended for clarity;
  • Language was moved from paragraph (B)(2) and (E)(1) to paragraph (B)(1);
  • Paragraph (E)(2) was moved to paragraph (B)(2)(j);
  • Paragraph (B)(3) was moved to paragraph (C) and updated for clarity;
  • Paragraph (C)(4) was added for clarity;
  • Paragraph (D)(2)(a) was amended for clarity;
  • Language was added to paragraph (D)(2)(b) for clarity;
  • Paragraph (E)(3) was moved to paragraph (D)(2)(c);
  • Paragraph (E)(4) was moved to paragraph(D)(2)(d);
  • The term “food assistance” was replaced with “Supplemental Nutrition Assistance Program (SNAP)”; and
  • Minor grammatical changes for clarity.
