This letter transmits the amendment of rule 5101:9-2-02 “The Americans with Disabilities Act” of the Administrative Code.  The rule has been amended as a result of the five-year rule review requirements contained in section 106.03 of the Revised Code.

The rule describes how the Americans with Disabilities Act Amendments Act, 42 U.S.C. section 12101 and section 504 of the Rehabilitation Act, 29 U.S.C. section 701 apply to programs supervised by the Ohio Department of Job and Family Services.  Changes to the rule include the following: updated references in paragraph (A), added additional language to paragraph (C)(3), put paragraphs (D)(1) and (D)(2) in list format, added clarifying language to paragraph (F) and made several other minor edits.
