SUBJECT: Amendment to Ohio Administrative Code (OAC) rule 5101:2-1-01) Family, Children and Adult Services Manual Transmittal Letter No. 467

This letter transmits amendments to existing Ohio Administrative Code rule 5101:2-1-01 to address the implementation of the Family First Prevention Services Act (FFPSA) of 2018 and to align with Ohio Revised Code (ORC) amendments and current practice and procedure language in Chapters 5101:2-5, 5101:2-7, 5101:2-9, 5101:2-33, 5101:2-36, 5101:2-37, 5101:2-38, 5101:2-39, 5101:2-40, 5101:2-42, 5101:2-44, 5101:2-45, 5101:2-47, 5101:2-48, 5101:2-49, 5101:2-50, 5101:2-52 and 5101:2-53 of the Administrative Code. The amendments will be effective August 6, 2021.

The following is a brief explanation of the changes:

OAC rule 5101:2-1-01 entitled "Children Services Definitions of Terms" identifies terminology and definitions utilized in Ohio’s child welfare system. The following terms have been added, defined and/or amended: "Adoption disruption, Adoption dissolution, Aftercare services, Aftercare support, Applicant, Approved adoptive home, Approved kinship home, At risk of institutionalization, Child, Criminal records check, Cultural competency, Disabled infant, Employee, Habilitation, Handicapped person, Intern, Interstate placement, Kin or Kinship caregiver, Mentally ill person subject to hospitalization by court order, Person responsible for a child's care in out-of-home care, Physically impaired, Plan for practice advancement, Pre-adoptive family, Protective day-care services, Putative father, Qualified alien, Quality assurance review, Resource Caregiver, Resource Family, State institution, Subcontractor, Transfer, Treatment foster home, Treatment team leader, Volunteer and Waiting child" to the definitions rule. The terms "Final Report, Hold status, Ohio adoption photo listing (OAPL), OAPL matches and Quality improvement plan" have been stricken from the rule due to the termination of the OAPL and other obsolete terms no longer used in Ohio Administrative Code rules.
