SUBJECT: House Bill 110 Changes to Publicly Funded Child Care Initial Eligibility Levels

Background:

The Publicly Funded Child Care (PFCC) income eligibility qualifications are set forth in Chapter 5101:2-16 of the Ohio Administrative Code (OAC) and are updated annually after the release of the Federal Poverty Level (FPL) Guidelines by the United States Department of Health and Human Services.

The passage of Amended Substitute House Bill No. 110 of the 134th General Assembly has set forth new income eligibility standards for families applying for initial PFCC eligibility in Section 307.280.

Implementation:

On or after August 12, 2021, families may meet income qualifications for PFCC, if their gross monthly income level is at or below one hundred forty-two percent of the FPL. Additionally, families that need care for a child with a verified special need may meet income requirements for PFCC if their gross monthly income level is at or below one hundred fifty percent of the FPL. Special needs child care is defined in rule 5101:2-16-01, OAC, as child care provided to a child who is less than eighteen years of age and either has one or more chronic health conditions or does not meet age appropriate expectations in one or more areas of development, including social, emotional, cognitive, communicative, perceptual, motor, physical, and behavioral development and that may include on a regular basis such services, adaptations, modifications, or adjustments needed to assist in the child's function or development.

The new monthly income standards are as follows:

* These amounts are determined using the 2020 Federal Poverty Guidelines as published in the Federal Register on February 1, 2020. If the family size is above 8, add $4,480 to the annual income for each additional household member.

The Child Care Information Data System (CCIDS) has been updated to include the new income eligibility standards. All initial applications made on or after August 12, 2021 will be based on these new standards.
