SUBJECT: Treatment of HIPAA Inquiries to a County Agency

This letter transmits amended rule 5101:9-9-20 "Treatment of Health Insurance Portability and Accountability Act (HIPAA) inquiries to a county agency," effective May 23, 2008.

The rule sets forth the definition of HIPAA as it relates to the rule, examples of protected health information, a description of the HIPAA privacy notice sent to individuals, and the action a county agency is required to take when an individual requests any of the procedures listed in the privacy notice.

There are no changes to the requirements under the rule. The rule was reviewed and then amended to clarify the definition of HIPAA, update the names of assistance programs, and expand the description of the HIPAA privacy notice.
