SUBJECT: Clarification to the Foster Care Maintenance (FCM) Reimbursement for Qualified Residential Treatment Program (QRTP) placements outlined in rule 5101:2-47-21 of the Administrative Code.

This Procedure Letter provides updated guidance related to a youth placed into a QRTP on or after October 1, 2021, for less than thirty days and a Child and Adolescent Needs and Strengths (CANS) is not completed.

BACKGROUND

Ohio Administrative Code rule 5101:2-47-21 (C) states when a child is placed into a QRTP for less than thirty-days and an assessment has not been completed the Title IV-E agency may claim FCM for the first fourteen-days of the QRTP placement, regardless of whether the child has had previous placements during the child’s foster care episode.

UPDATED GUIDANCE

Public Law 115-123 states a youth is eligible for reimbursement in a non-QRTP for the first fourteen (14) days. However, for a youth placed in a QRTP, if the assessment is not completed within 30 days, the title IV-E agency cannot claim title IV-E FCM for the entirety of the QRTP placement (this exclusion applies to the first 14 days) but may claim title IV-E administrative costs during the placement in the QRTP.
