This letter transmits amendments to Ohio Administrative Code
(OAC) rules 5101:2-42-06 and 5101:2-42-07 as a result of five-year rule review.
The rules will be effective July 1, 2024.
The following is a brief summary of the changes and additions.
OAC 5101:2-42-06 entitled Agreement for
temporary custody of child prescribes the form to be used by agencies
for an agreement of temporary custody of a child pursuant to 5103.15 of the
Revised Code. The rule has been amended to remove the revision date from the
form referenced in the rule and regulatory restrictive words as described in
Senate Bill 9 of the 134th General Assembly have been removed.
OAC 5101:2-42-07 entitled Extension of
agreement for temporary custody of child prescribes the form to be used
by agencies to extend the agreement of temporary custody of a child pursuant to
5103.15 of the Revised Code. The rule has been amended to remove the revision
date from the form referenced in the rule and regulatory restrictive words as
described in Senate Bill 9 of the 134th General Assembly have been
removed.
JFS Form 01645 entitled Agreement for
temporary custody of child is the form used by an agency to initiate an
original agreement or additional thirty day extension, to receive temporary
custody of a child. The form is being amended for the five year rule review
process and the revision date has been changed.
INSTRUCTIONS:
The following chart depicts what materials should be deleted
from the Family, Children and Adult Services Manual (FCASM) and what materials
are to be inserted in the FCASM.
