This letter transmits amendments to Ohio Administrative Code (OAC)
Rules 5101:2-42-18.1 and 5101:2-48-13 as a result of the Common Sense Initiative
Office project to revise outdated language and terminology regarding communication
methods in OAC rules. The following is a brief explanation of the changes that will
be effective May 1, 2022.
OAC 5101:2-42-18.1 entitled Non-Discrimination
Requirements for Foster Care Placements explains that race, color or national origin
(RCNO) may not be considered in the placement process for foster care placement,
and outlines what is prohibited and permitted when selecting a foster care placement.
It also details steps to be taken should RCNO become a compelling factor in the
placement process. Paragraph (J)(2) was amended to change the language from “signature
date of the caseworker for an” to “completion date of the” individual child assessment.
Also, revision dates for the forms were removed throughout.

5101:2-48-13 entitled
Non-Discrimination Requirements for Adoptive Placements explains that RCNO may not be considered in the
placement process for an adoptive placement, and outlines what is prohibited and
permitted when selecting an adoptive placement. It also details steps to be taken
should RCNO become a compelling factor in the placement process. Paragraph (F) was
replaced, as the requirements were obsoleted per Procedure Letter No. 325 in January
2018. Paragraph (M)(2) was amended to change the language from “signature date of
the caseworker for an” to “completion date of the” individual child assessment.
Also, revision dates for the forms were removed throughout.
INSTRUCTIONS:
The following chart indicates the material that should be removed
from the Family, Children and Adult Services Manual (FCASM) and the materials that
are to be inserted in the FCASM.
