This letter transmits an amended Ohio Administrative
Code (OAC) rule that is to meet the federal requirements related to the Family First
Prevention Services Act. The revision of this rule is necessary to ensure that requirements
for implementation of Qualified Residential Treatment Placement (QRTP) are met within
rule, and to also secure the ability of agencies to receive Title IV-E reimbursement
funds for QRTP placement. This rule is effective March 21, 2022.
The following is a brief
explanation of the changes to this rule:
OAC 5101:2-47-21 "Title IV-E Foster Care Maintenance (FCM) reimbursement for a child
placed into a Qualified Residential Treatment Program (QRTP)"outlines
the reimbursement requirements for a child placed into a QRTP. The rule is
being amended to remove paragraph (C). Public Law 115-123 states a child is eligible
for reimbursement in a non-QRTP for the first fourteen (14) days. However, for a
child placed in a QRTP, if the assessment is not completed within 30 days, the title
IV-E agency cannot claim title IV-E FCM for the entirety of the QRTP placement (this
exclusion applies to the first 14 days) but may claim title IV-E administrative
costs during the placement in the QRTP. Paragraphs (H), (I) and (S) were revised
to explain when a child placed into a non-QRTP is eligible for reimbursement when
the setting becomes QRTP compliant.
