This letter transmits the review of Ohio Administrative Code
(OAC) rule 5101:2-36-14 that addresses the requirements for Protective Service
Alerts. Training has been presented to
public children services agencies (PCSAs) regarding SACWIS enhancements related
to this rule. This rule is effective as of May 3, 2021.
The following is a brief explanation of the changes to this
rule:
OAC 5101:2-36-14 entitled Protective Service Alert sets forth the requirements that
apply to public children services agencies (PCSAs) when issuing a protective
service alert (PSA) upon receipt of an abuse or neglect report when the
whereabouts of a child or his or her parent, guardian, or custodian are
unknown, and the PCSA has reason to believe the child is in immediate danger of
serious harm. The assignment of an
originating PCSA has been removed from rule to allow any PCSA to document
changes to the PSA in SACWIS. The
expiration date of a PSA has been changed from ninety days to be a minimum of
one year from the date of issuance of a PSA, and the time period for extension
of PSA has been modified to be one year from the date of extension. Training
has been presented to Ohio PCSAs regarding the SACWIS enhancements resulting
from these rule changes. Additionally, the paragraph order has been
restructured throughout the rule in accordance with the changes.
