This letter transmits amendments to the Ohio Administrative Code
(OAC) rule 5101:2-38-08 addressing the
education and health information of children in care. This rule has been
amended to provide clarity to public children services agencies (PCSA) charged
with the child protective services function. This rule has been reviewed by the
Partnership for Ohio's Families (PFOF) Rule Review initiative which included
preclearance, and the internal and external clearance process. The following
OAC rule has been amended: 5101:2-38-08. This rule will become effective
December 15, 2020.
The following is a brief explanation of the changes to the rule.
OAC 5101:2-38-08 entitled Child’s
Education and Health Information sets forth the PCSA requirements
for obtaining and documenting the education and health information relating to
children in their care. A clarification has been made that the “PCSA case
record” is the State Automated Child Welfare Information System (SACWIS), and
that all documentation and the JFS 1443 form are contained and completed within
SACWIS. Further, a minor revision was made to include a place to document
ongoing or specialty appointments. Grammatical changes, restructuring the order
of paragraphs, and amendments to requirements for consistency have occurred
throughout the rule.

The following chart indicates the materials that should be
removed from the Family, Children and Adult Services Manual (FCASM) and the
materials that should be added.
