This letter transmits a new Ohio Administrative Code (OAC) rule
5101:2-33-27 entitled Title IV-E Agency Contracting for
Non-Placement Services. This rule sets forth the requirements for the Title
IV-E agency when using the new statewide Agreement for Title IV-E agencies for
the Provision of Non-Placement Services (non-placement agreement). A Title IV-E agency is required to use the
“non-placement agreement” when contracting for aftercare support from a
qualified residential treatment program (QRTP) at a different rate than the
Medicaid rate for non-Medicaid eligible children. A Title IV-E agency may
choose to use the "non-placement agreement" for aftercare services or
any non-placement service contract. Each Title IV-E agency is to enter all
information on the "non-placement agreement," including the
"Title IV-E schedule B rate information (schedule B)" into the Ohio
statewide automated child welfare information system (Ohio SACWIS). The “non-placement agreement” will be
available for usage September 1, 2021, as indicated and this rule will be
effective October 28, 2021.
