This letter transmits three rules regarding foster care as a result of the five-year review.  These rules will be effective July 9, 2021.

The following is a list of the changes:

OAC 5101:2-5-08 entitled PCPA and PNA Governance and Administration provides guidance on private agency requirements for the administration of the agency.

Paragraph (A)(3) was amended to remove rule chapter numbers.

OAC 5101:2-5-11 entitled Complaint Handling provides guidance to agencies on procedures and requirements for follow up regarding a complaint made to ODJFS regarding an incident involving the agency. Rule chapter numbers were removed from paragraphs (A)(1) and (B).

OAC 5101:2-5-17 entitled Discharge Summary provides guidance to agencies about the requirements of a discharge summary for a child in care. Residential facility language was removed from paragraph (A) and added to a new paragraph (E).  A grammatical clarification was made in paragraph (C). Paragraph (E) also implements the new RTIS system for entering residential facility information.

INSTRUCTIONS:  The following chart depicts the material that should be deleted from the Family, Children and Adult Services Manual (FCASM) and the materials that are to be inserted in the FCASM.
